Terms of Service

By accessing or using the HookGenius platform, website, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and HookGenius, Inc. ("HookGenius," "we," "us," or "our").

We reserve the right to update or modify these Terms at any time. When we do, we will revise the "Effective Date" at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms. We encourage you to review these Terms periodically.

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service. By creating an account, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

• You are responsible for safeguarding your account credentials, including your password.
• You must notify us immediately at support@hookgeniuspro.com if you suspect unauthorized access to your account.
• You are responsible for all activities that occur under your account, whether or not you authorized them.
• We reserve the right to suspend or terminate accounts that we reasonably believe have been compromised.

HookGenius provides AI-powered tools for YouTube content creators, including but not limited to:

• AI headline generation with viral scoring and CTR predictions
• Hook script creation with retention predictions and visual cues
• A/B title testing with statistical analysis
• Trend intelligence and competitor analysis
• Content export and project management tools

Scores, predictions, and analytics provided by the Service are estimates based on algorithmic models. They are not guarantees of actual performance on YouTube or any other platform.

HookGenius offers multiple subscription tiers (e.g., Free Trial, Creator, Pro, Agency), each with different features and usage limits. Details of current plans and pricing are available on our Pricing page.

• Free Trial: New users may receive a 14-day free trial with access to Pro features. No credit card is required to begin the trial.
• Paid Subscriptions: After the trial period, continued access to paid features requires selecting and paying for a subscription plan. Subscriptions are billed on a monthly recurring basis.
• Payment Processing: Payments are processed securely through our third-party payment provider (Stripe). By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel.
• Plan Changes: You may upgrade or downgrade your plan at any time. Upgrades take effect immediately, and downgrades take effect at the end of the current billing cycle.
• Price Changes: We may adjust pricing with at least 30 days written notice. Continued use after a price change constitutes acceptance.

• You may cancel your subscription at any time through your account settings or by contacting us at support@hookgeniuspro.com.
• Upon cancellation, you will continue to have access to paid features until the end of your current billing period.
• We do not provide prorated refunds for partial months of service. However, if you cancel within the first 7 days of a new billing cycle and have not substantially used the Service during that period, you may request a refund at our discretion.
• If you believe you were charged in error, contact us within 30 days of the charge for review.

You agree not to use the Service to:

• Violate any applicable law, regulation, or third-party rights
• Generate content that is defamatory, obscene, threatening, or promotes hatred, violence, or illegal activities
• Attempt to reverse engineer, decompile, disassemble, or otherwise derive the source code or algorithms of the Service
• Interfere with, disrupt, or overburden the Service or its infrastructure
• Use automated tools, bots, scrapers, or similar methods to access or extract data from the Service beyond its intended API interfaces
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Share your account credentials or allow others to access the Service through your account (except for authorized team members on Agency plans)
• Use the Service to generate misleading or fraudulent content designed to deceive viewers

We reserve the right to investigate and take appropriate action, including suspension or termination of your account, for any violations of these Terms.

Our Property

The Service, including its software, algorithms, design, trademarks, and all related content, is owned by HookGenius, Inc. and is protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except for the limited license to use the Service as described herein.

Your Content

You retain ownership of any content you input into or create using the Service (e.g., video descriptions, generated headlines, hook scripts). By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing and improving the Service.

Generated Content

Headlines, hook scripts, and other outputs generated by the Service are provided for your use without restriction. However, due to the nature of AI generation, similar outputs may be generated for other users. We do not guarantee the uniqueness of any generated content.

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in the Privacy Policy.

The Service may integrate with or link to third-party services (e.g., YouTube, Stripe). Your use of such third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the content, practices, or availability of third-party services.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, error-free, or secure
• Predictions, scores, or analytics will be accurate or reliable
• Use of the Service will result in any particular YouTube performance metrics (views, CTR, subscriber growth, revenue, etc.)
• Generated content will comply with YouTube's terms of service or policies

You are solely responsible for ensuring that any content you publish complies with applicable laws and platform guidelines.

To the maximum extent permitted by applicable law, HookGenius, Inc., its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of the Service.

Our total aggregate liability for any claims arising from or related to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months preceding the claim, or (b) one hundred US dollars ($100).

You agree to indemnify, defend, and hold harmless HookGenius, Inc. and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create, publish, or distribute using the Service

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:

• Your right to use the Service will immediately cease
• We may, but are not obligated to, delete your account data after a reasonable retention period
• Any provisions of these Terms that by their nature should survive termination (including limitations of liability, indemnification, and dispute resolution) will survive

You may terminate your account at any time by contacting us at support@hookgeniuspro.com or through your account settings.

Any disputes arising from or related to these Terms or the Service shall be resolved as follows:

• Informal Resolution: Before initiating formal proceedings, you agree to contact us at support@hookgeniuspro.com and attempt to resolve the dispute informally for at least 30 days.
• Binding Arbitration: If informal resolution fails, disputes will be resolved through binding arbitration administered by a recognized arbitration organization, conducted in English. The arbitrator's decision will be final and binding.
• Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

These Terms, together with our Privacy Policy and any applicable plan-specific terms, constitute the entire agreement between you and HookGenius, Inc. regarding your use of the Service and supersede all prior agreements and understandings.
